OSHA Injury Reports

This OSHA Injury Report was compiled directly from data that is publicly available from the Occupational Safety and Health Administration (OSHA). OSHA Injury Reports can be helpful in understanding the types of workplace injury claims involving defective products or malfunctioning equipment in the workplace. 

The manufacturers of defective equipment or machinery resulting in a worker injury may be found to be negligent and liable for damages in a separate civil lawsuit. You may be able to recover damages on top of a workers’ comp claim if injured in a job accident caused, in part, by a third party. An employee opened a rail car that contained sulfur and was possibly exposed to sulfuric acid vapors. The employee either jumped off the rail car or fell off the rail car. The employee was not wearing fall protection or a respirator. The employee was taken to the hospital.

On August 03, 2015, at approximately 4:00 p.m., an employee operating a forklift was loading a metal part onto a pallet. A second employee saw the part rolling and attempted to stop it with his foot. The pipe rolled off the pallet and his leg got caught and injured under the part.
